We collect only what we need to answer you, plan your project and deliver our services. We never sell your personal data. We do not use advertising or analytics cookies on this website. You can ask to see, correct or delete your data at any time.
1. Who we are
THEFALCONET ("Falconet", "we", "us") is a content, web and AI agency. We are the controller of the personal data described in this policy, which explains how we handle it when you visit theflaconet.com, contact us, book a call or work with us.
For any privacy question or request, email falconet@theflaconet.com.
2. What we collect
Information you give us
- Booking and contact details: your name, business name, email address, phone number, website or social handles, and anything you tell us about your business and goals.
- Client information: contact details for your team, billing details, contract records, and the brand materials, feedback and account access you share during a project.
- Communications: emails, messages, call notes and, with your agreement, call recordings.
Information collected automatically
- Technical data: when you visit the site, our hosting provider records standard server logs, such as your IP address, browser type, pages requested and the time of the request, to deliver the site and keep it secure.
- Device storage: a few small items stored in your browser make the site work and remember your cookie choice. Our Cookie Policy lists every one.
We do not ask for sensitive information, such as health data, and ask you not to send it.
3. How we use it and our legal bases
| Purpose | Legal basis |
|---|---|
| Answering your enquiry, arranging your free call and preparing a plan and quote | Steps you asked for before entering a contract |
| Delivering the services, managing the project and communicating with you | Performance of our contract with you |
| Invoicing, accounting and tax records | Legal obligation |
| Running, securing and improving our website and services | Our legitimate interests |
| Sending news, offers and insights by email | Your consent, or our legitimate interests for existing clients (you can opt out at any time) |
| Showing finished client work in our portfolio | Our legitimate interests, or consent where required |
| Establishing, exercising or defending legal claims | Our legitimate interests |
We do not use your personal data for automated decisions that have legal or similarly significant effects on you.
4. Marketing emails
We only send marketing emails if you have agreed to receive them, or if you are a client and the emails relate to similar services. Every marketing email has an unsubscribe link, and you can also simply reply asking us to stop.
5. Who we share it with
We never sell or rent your personal data. We share it only when needed, with:
- Service providers who help us run the business, such as website hosting, email, scheduling, video calls, file storage, invoicing and payment providers, all bound by contracts to protect your data and use it only on our instructions;
- Freelancers and subcontractors working on your project, under confidentiality obligations;
- Platforms you ask us to use, such as social networks, ad platforms, telephony and AI providers, under their own terms and privacy policies;
- Professional advisers, such as accountants and lawyers;
- Authorities, where the law requires it;
- A buyer or successor, if our business is reorganised, merged or sold, under the same protections.
6. International transfers
We work with clients worldwide, and some of our service providers are based in other countries. When personal data is transferred outside the UK or the European Economic Area, we rely on adequacy decisions or on safeguards such as the European Commission's Standard Contractual Clauses. You can ask us for more information about these safeguards.
7. How long we keep it
- Enquiries that do not become a project: up to 12 months after our last contact.
- Client records and contracts: for the engagement and up to 6 years after it ends, to meet tax, accounting and legal requirements.
- Marketing preferences: until you unsubscribe; we then keep a minimal record so we do not email you again.
- Server logs: for a short period, normally no more than 90 days, unless needed to investigate a security issue.
After these periods we delete or anonymise the data.
8. Security
We protect personal data with appropriate technical and organisational measures, including encrypted connections, access limited to the people who need it and secure handling of client logins. No system is completely secure, so if we ever become aware of a breach that affects you, we will notify you and the relevant authority where the law requires.
9. Your rights
Depending on where you live, you may have the right to:
- access the personal data we hold about you and receive a copy;
- correct data that is inaccurate or incomplete;
- ask us to delete your data;
- restrict or object to how we use it, including for direct marketing;
- receive your data in a portable format;
- withdraw your consent at any time, without affecting earlier processing.
To use any of these rights, email falconet@theflaconet.com. We will reply within one month and may ask you to confirm your identity. You also have the right to complain to your local data protection authority, although we would appreciate the chance to resolve your concern first.
California and other US residents: we do not sell personal information or share it for cross-context behavioural advertising. You may request access to or deletion of your personal information, and we will not treat you differently for doing so.
10. Data we handle for clients
When we run AI agents, ad campaigns or social accounts for a client, we may process personal data of that client's customers, such as callers, leads or people who send messages. In that case the client is the controller, we act as its processor under a data processing agreement, and the client's own privacy policy applies. If you are a customer of one of our clients, please contact that business to exercise your rights; we will help them respond.
11. Children
Our website and services are intended for businesses and are not directed at children under 16. We do not knowingly collect personal data from children.
12. Changes to this policy
We may update this policy when our services or the law change. The date at the top shows when it was last updated, and we will tell clients about significant changes by email.
